These terms of use ("Terms") constitute a legally binding agreement between you and NCS rentals LLP (the "Company/ We/ Rentalex or Us") regarding the use of the application/ website www.rentalexapp.com (the "Site") or the domain thereof and any service offered or deemed to be offered by the Company including but not limited to delivery of content via the Site, any mobile or internet connected device or otherwise ("Service").

Rentalex app’s purpose is to create an online peer-to-peer platform where Users connect seamlessly to buy, sell, rent, or hire Properties, Services/Talents, Vehicles, Others and post an Ad under Wanted to help you find what you’re looking for. We present you these Terms and Conditions so that You can understand the scope of Our Services and the Terms governing Your use of the platform. These Terms and Conditions (“User Terms”) apply to the use of the App, as well as to all information, recommendations, and or services provided to You through the App.

By continuing to use Our App, You are consenting to be bound by these User Terms. In case of non-acceptance of the User Terms, the entitlement of usage of services through the App provided therein will be void. YOUR AGREEMENT TO THESE USER TERMS SHALL OPERATE AS A BINDING AGREEMENT BETWEEN YOU AND RENTALEX WITH RESPECT TO THE USE AND SERVICES PROVIDED BY RENTALEX.

Your acceptance of the User Terms shall be deemed to include your acceptance of the privacy policy. By accepting these User Terms, you also allow Rentalex to send you promotional emails and SMS alerts from time to time.

All of the defined and capitalized terms in these User Terms will have the meaning assigned to them here below:

1. “Account” means the account created by You on the Rentalex App for availing the Services provided.
2. “Ad(s)” means classified advertisement of Property, Services/Talents, Vehicles, Wanted, and Others.
3. “Applicable Laws” means and include all applicable statutes, enactments, acts of legislature or parliament, laws, ordinances, rules, by-laws, regulations, notifications, guidelines, policies, directions, directives, and orders of any governmental authority, tribunal, or a court of the concerned country where from a User register itself.
4. “Application” or “App” means the mobile App “Rentalex” or its updated version at any point in time.
5. “Buyers” means the legal person who is looking for the Property (Residential or Commercial), Vehicle, and others articles posted under Others to buy. In the case of a juristic entity, it will include the authorized person for any transaction or communication on the platform.
6. “Force Majeure Event” means any event arising due to any cause beyond the reasonable control of Rentalex.
7. "Hirer” means the legal person hiring Services/Talent(s). In the case of a juristic entity, it will include the authorized person for any transaction or communication on the platform.
8. “Owner” means: (i) a person who owns Property, Vehicle, Object/Thing, or has been authorized by the legal owner to post an Ad for its sale/rent/lease/license, etc. (Collectively, Seller and Owner will be termed as “Owner” in User Terms and privacy policy) (ii) Person who owns the Property or has been authorized by the legal owner of the Property to post an Ad to sell/rent/lease/license it. (iii) Person who has a business or professional degree or skills for services offered as Services/Talents. (iv) Person who owns the Vehicle or has been authorized by the legal owner of the Vehicle to post an Ad to sell (v) Person who owns an object or thing of tangible and transferable nature and is willing to part with, for a consideration that he deems appropriate to transfer risk and reward with it. For instance, furniture, household accessories, etc. (vi) Owner also means “Seller” The owner is willing to sell/transfer ownership, liability, risk, and reward by posting an ad on Rentalex to a willing/consenting buyer for a consideration that he/she deems appropriate or is willing to rent an object/thing which is tangible, movable, without transfer of ownership, liability, risk, and reward by posting an ad on Rentalex to a willing/consenting Renter for a consideration that he/she deems appropriate. (All or any of the above will be termed as “Owner” in User Terms and privacy policy)
9. “Services/Talents” means a profession or job in which You are skilled. For instance, ‘doctor’ is a profession and will be considered Services/Talents in the App.
10. “Tenant(s)” means the legal person who is looking for a Property to rent/lease/license for residential or commercial purposes. In the case of a juristic entity, it will include the authorized person for any transaction or communication on the platform.
11. “Property” means immovable property/properties meant for residential or commercial purposes.
12. “Rent” means: rent/lease/license a Property/object/thing in context of Tenants and Renters.
13. "Renter" means a person who is willing to rent a Property or object/thing which is tangible, movable, without transfer of ownership, liability, risk, and reward.
14. “Hirer” means who Hires Services/Talents through Rentalex.
15. “Rentalex” or “Us” or “We” or “Our” means NCS Rentals LLP, unless it is repugnant to the context or meaning thereof, be deemed to mean and include its Partners, employees, and Service Provider.
16. “Registration Data” means and may include the present, valid, true, and accurate name, email ID, phone number, and such other information as may be required by Rentalex from You from time to time for registration on the App.
17. “Service(s)” means the facilitation of providing a platform for posting Ads through the App, as elaborated in Clause 4.
18. “You” or “User” means a legal person who has an Account on the App.
19. “User Terms” means these Terms and conditions.
20. “Wanted” means if a user is unable to find a Property, Services/Talent (skills), shop, Vehicles, jobs, electronics, or others, on our app then in such an event, the user can post an ad under Wanted, describing his/her need. All ads posted under wanted will be reflected on the home interface except real estate. Rentalex will be responding to it in 48 hours in pursuance of the ad posted under the wanted category via email and WhatsApp on the registered email and phone number respectively.
21. “Vehicle” means an automobile for example; car, bike, bus, truck, etc. that the owner is willing to sell by transferring ownership, liability, risk, and reward by posting an ad on Rentalex to a willing/consenting buyer for a consideration that he/she deems appropriate under vehicles.
22. “Others” means any object or thing, which is tangible, movable, and transferable in nature and toward which the User has propriety rights and is willing to sell by transferring ownership, liability, risk, and reward by posting an ad on Rentalex to a willing/consenting buyer for a consideration that he/she deems appropriate or is willing to rent an object/thing which is tangible, movable, without transfer of ownership, liability, risk, and reward by posting an ad on Rentalex to a willing/consenting Renter for a consideration that he/she deems appropriate.

You will be “Eligible” to use the Services only when You fulfill all of the following conditions: (i) You have attained at least 18 (eighteen) years of age and (ii) You are competent to enter into a contract under the Applicable Laws in your respective country. If You are a minor, You cannot avail any of Our services. Any transaction done by You on the platform will be deemed to be done by Your legal Guardian/Parents.

1. You understand and acknowledge that You can register on the App only after complying with the requirements of this Clause 3 and by entering Your Registration Data.
2. You shall ensure that the Registration Data provided by You is accurate, complete, current, valid, and true and is updated from time to time. We bear no liability for false, incomplete, old, or incorrect Registration Data provided by You.
3. You are solely responsible for maintaining the confidentiality of Your Registration Data and will be liable for all activities and transactions that occur through Your Account, whether initiated by You or any third party. Your Account cannot be transferred, assigned or sold to a third party. We will not be liable for any loss that You may incur as a result of someone else using Your password or Account, either with or without Your knowledge.
4. We reserve the right to suspend or terminate Your Account with immediate effect and for an indefinite period, if We have a reason to believe that the Registration Data or any other data provided by You is incorrect or false, or that the security of Your Account has been compromised in any way, or for any other reason, We may find just or equitable.
5. Except for the Registration Data or any other data submitted by You during the use of any other service offered through the App (“Permitted Information”), Rentalex does not want You to, and You should not, send any confidential information to Rentalex on the App or otherwise unless otherwise is required by Applicable Laws of the country where the User is residing. Upon accepting these User Terms, You agree that any information or materials that You or individuals acting on Your behalf provide to Rentalex other than the Permitted Information will not be considered confidential. If You share Your information with Third-party during transactions or communication then You are solely liable for any misuse of Your information.
6. It is Your responsibility to check and ensure that You download the correct App for Your device. We are not liable if You do not have a compatible mobile device or if You download the wrong version of the App for Your mobile device. We reserve the right to terminate the Service and the use of the App if We have reasons to believe that Your device is unauthorized.
7. We allow You to open only one Account in association with the Registration Data provided by You. In case of any unauthorized use of Your Account please immediately reach us at support@rentalexapp.com.
8. In case, You are unable to access Your Account, please inform us at support@rentalexapp.com and make a written request for blocking Your Account. We will not be liable for any unauthorized transactions made through Your Account.

Our App provides true free ad posting and a user-friendly interface to conveniently view the listed Properties, Services/Talents (skills, shop or business), Vehicles, Wanted, and Other ads. You can post up to 100 free ads and after posting 5 ads, watch a reward video to unlock 5 more and so forth. All the ads pertaining to Properties, Services/Talents (skills, shop or business), Vehicles, Wanted, and Others ads will be listed together on the home interface. The Owners/Sellers and Buyers/Tenants/Hirers can communicate directly with each other and decide the terms for their transactions. Rentalex is not and cannot be a party to or control in any manner any transaction between the platform's Users. You will solely be responsible for any transaction or communication made via our App. To post your ad on Rentalex click on the post button on the home ui and choose from the following:

1. Properties: All ads pertaining to your residential or commercial property, either for selling or for renting/leasing are posted through it.
2. Services/Talents: To showcase your Services/Talents, (skills, shop, or business) post an ad under Services/Talents.
3. Vehicles: To sell your car, bike, bus, truck, etc. post an ad under Vehicles.
4. Wanted: “Wanted” means if a user is unable to find a Property, Services/Talent (skills, shop or business), Vehicles, jobs, electronics, or others, on our app then in such an event, the user can post an ad under Wanted, describing his/her need. All ads posted under wanted will be reflected on the home interface except real estate. Rentalex will be reaching out to you in 48 hours in pursuance of the ad posted under the wanted category, either via email or WhatsApp.
5. Others: means any object or thing, which is tangible, transferable, and movable in nature, toward which the User has propriety rights and has posted an ad on Rentalex to sell or rent for a consideration that he/she deems appropriate. For instance, furniture, refrigerator, mobile phone, and other domestic and commercial equipment.

No verification or physical monitoring is done by us of the above-stated categories. Verification only indicates the direct ownership i.e. not sold/rented by a second or third party.

Listing Property, Services/Talents (skills, shops, and business), Vehicles, Wanted, and Others ads on the App is free of cost, and You can browse freely on the App and view the catalogue of the listed ads. However, Rentalex offers paid service(s) which can be availed on payment of the mentioned fees.

By availing of this service, Your Ad will be displayed on top of the listings in the home ui, above the one-hour boosted and non-boosted Ads, highlighted with the word ‘BOOSTED’. It may increase the reach of your Ad to a larger audience. We do not warrant that it will make Your Ad get offers, sooner or more than non-boosted listings. Since, we believe in transparency, We have mentioned herein the price model of Our service based on the number of days You choose to feature Your Ads.

**Here rates are reflected in INR (Indian rupee), It will change with the currency of the country wherein services are being offered by Rentalex.**

NOTE: -

1. You can also avail of the ‘Boost up’ feature for free by watching a third-party advertisement reward video and this would boost up your Ad for up to an hour and can be done simultaneously for all posted Ads.
2. Opting for ‘Boost up’ through payment plan i.e., Platinum, Gold, Silver for 30, 15, and 10 days respectively will make you eligible to select any Ad of your posted Ads (in case you have posted multiple Ads) within the stipulated days of the chosen plan to be boosted up i.e., it will be displayed at the top of non-boosted ads.
3. To simultaneously ‘Boost up’ 2 or more Ads, You have to buy 2 or more plans.

Payment Policy

On the selection of any of the plans mentioned in the App, You will be directed to the payment gateway. It is only upon the receipt of the Payment and generation of an invoice by Razorpay/Stripe, You will get the benefits of the Paid Services. You warrant that You are legally allowed to make the payment by using the respective payment methods in the gateway.

1. Any issue arising during Payment;
2. Misuse of Your Payment details by Third-party;
3. The decline of the Payment for any reason.
4. Refund/Cancellation of the Payment

You agree and acknowledge that the Deletion or deactivation of your Account by You will not make us liable to Refund fees for the remaining time period of the Paid Services plan You chose. If after receipt of payment and confirmation by the generation of the invoice, You cannot avail Your selected Plan due to technical error, You may let us know at support@rentalexapp.com, We may Refund the amount or try to resolve the technical issue. In case of a refund, we normally refund to the Users within 5-7 working days.

Rentalex may at its sole discretion introduce new services and modify some or all of the existing services offered on the Platform. In such an event Rentalex reserves the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. The Changes will be made available on the App. The fees may vary for Users residing Outside India.

Rentalex has the right but not the obligation, to monitor the content of the App, including chat rooms, to determine compliance with this agreement and Privacy Policy, and to satisfy any law, regulation, or authorized government request. Rentalex reserves the right, at any time and without prior notice, to remove or disable access to any content, refuse to post or remove any material that Rentalex, at its sole discretion, considers to be in violation of these User Terms or otherwise harmful to the App.

Rentalex has the right to investigate and prosecute violations of any of the above to the fullest extent of the law. Rentalex may involve and cooperate with law enforcement authorities in prosecuting Users who violate these User Terms.

Rentalex assumes that the Owner has intellectual property rights (“IP rights”) over the contents of the Ad submitted and licensed to us in clause 5.1. We are not liable for infringement of intellectual property rights by You or Third-party. You are solely responsible for the protection of Your intellectual property rights.

We have all rights over the Application including title, interest, and all related intellectual property rights over the feedback and recommendations We receive. You must not reproduce any material (including images, graphics, software, text, animation, etc.) or marks (including trademark, names, logo, service marks, etc.) available on the App which might result in infringing Our or Third-Party IP rights. Refer to clause 17 to understand Our takedown process.

Rentalex will not be liable for:

1. Error or technical glitches in App;
2. Loss of Registration data;
3. Technical error during Payment or availing any of Our Services;
4. Loss of Profit, any loss of goodwill, data, or any tangible loss;
5. Modification or termination of Our services with/without prior notice;
6. Your failure to keep Your information secure and confidential;
7. Network error during communication on the Platform;
8. Unauthorized access or use of Your account;
9. Genuineness, authenticity, accuracy, and truth of the Contents of the Ad listed on the App;
10. False content or any mistake in the content;
11. Any error, interruption, or inability to access Your Account
12. Any bugs, viruses, trojan horses, or the like which may be transmitted to or through the platform by any third party;
13. The authenticity of links of Third-Party websites.
14. Any injury whether personal or private of any kind happening in consequence to use of the App or Services provided by Rentalex;
15. Any damages arising in consequence of these User Terms or Services whether direct or indirect irrespective of the fact that We had knowledge of the issue.
16. Rentalex has the right but not the obligation to take down posts in violation of Applicable laws of the country where the User resides except as mentioned in clause 16.2. You agree that Rentalex will not be liable for such content in the Posts and NO ACTION CAN BE TAKEN FOR SUCH CONTENT IN THE POSTS AGAINST RENTALEX.
17. In no circumstances or under any law liability of Rentalex arising from these User Terms or consequence of services will exceed an amount of 500/- rupees.

1. Rentalex is merely an electronic platform to facilitate the posting of online classified Ads and does not list any advertisement on its own. It means that ads are posted by Users as Owners/Sellers under Properties, Services/Talents, Vehicles, Wanted, and Others category. We do not endorse, advise or recommend You to Buy, Rent, Lease or Hire from the listed Property, Services/Talent, Vehicles, and Others. We, in no manner guarantee or assure the accuracy, authenticity, genuineness, and truth of any contents of the Ad(s).
2. Rentalex publishes classified Ad(s) posted by Owners/Seller on an “as is” or "as available" basis without warranties of any kind, either explicit or implied, including without limitation (i) warranties of title or condition of object or thing, movable or immovable posted in the Ad (Property, Vehicle, Other object or things posted under the Others category) and non-infringement of Proprietary Rights or; (ii) warranties of expertise or skills in listed Services/Talent. You acknowledge, by Your access to the App and availing of Services, at Your sole risk, that You assume full responsibility for Your access and use of the App and/or App, and that Rentalex is not liable for any damages of any kind related to Your access and use of this App and/or App.
3. Rentalex only provides a Platform to facilitate Owners/Sellers/Renter to reach a larger audience for their Ads (Property, Services/Talent, Vehicles, Wanted, and Others) and for communication. It is agreed by You that the agreements for (i) rent/lease/license or sale of any of the Property, Vehicles, and Others or (ii) engagement of Services/Talent(s), listed on the App will be a strictly bipartite contract between the Owner/Seller and the Buyer/Tenant/Hirer/Renter.
4. The listings on the App are merely an invitation to offer, it means that the Buyers/Tenants/Hirers/Renter can make an offer to the Owners/Seller to Buy/Rent/Hire the Property, Services/Talents, Vehicle, and others at listed price or negotiate and it is the sole discretion of the Owner/Seller to accept or reject the offer made or make a counter offer. All agreements and commercial/contractual terms are offered by and agreed to between Owners/Seller and Buyers/Tenants/Hirers/Renter alone. The commercial/contractual terms include without limitation, terms of the contract, payment methods, warranties related to the Property, Services/Talents, Vehicles, and Others, and any service after the agreement is made. Rentalex does not have any control or does not determine or advise or in any way involve itself in the offering or acceptance of such commercial/contractual terms between the Buyers/Tenants/Hirers/Renter and Owners/Seller. The invitation to offer on App is made by the Owner/Seller and not by Rentalex.
5. Rentalex does not make any representation or warranty as to specifics (such as quality, creditworthiness, identity, value, authenticity, genuineness, description, etc.) of the Ads listed on the Platform. You are advised to independently verify the bona fides of any particular User that You choose to deal with on the Platform and use Your best judgment on that behalf. Rentalex accepts no liability for any errors or omissions, whether on behalf of itself or third parties.
6. Rentalex is not responsible for any non-performance or breach of any contract entered into between Buyers/Tenants/Hirers/Renter and Owners/Seller. Rentalex cannot and does not guarantee that the concerned Buyer/Tenant/Hirer/Renter or Owner/Seller will perform any transaction concluded on the App. Rentalex will not and is not required to mediate or resolve any dispute or disagreement between Buyers/Tenants/Hirers/Renter and Owners/Seller.
7. Rentalex does not at any point of time during any transaction between Buyer/Tenant/Hirer/Renter and Owner/Seller on the Platform come into or take possession of any of the products or services offered by Owner/Seller nor does it at any point gain title to or have any rights or claims over the products or services offered by Owner/Seller to Buyer/Tenant/Hirer/Renter.
8. By verified mark on the Properties, Services/Talent, Vehicles, Wanted, and Others listings, We do not warrant that the claim in the Ad is genuine, true, original, and authentic. The verified mark does not guarantee more response on the app.

The invalidity of any term of these User Terms will not affect the validity of the other provisions of these User Terms. If and to the extent that any provision of these User Terms is invalid, or is unacceptable in the given circumstances, a provision will apply between the parties instead that is acceptable considering all the circumstances, taking into account the content and the purpose of these User Terms.

Rentalex reserves the right, at its sole discretion, to modify or replace, in part or full, any of these User Terms, or change, suspend, block, discontinue or restrict Your use of all or any feature of the Service or App at any time.

We will notify You of any changes made to these User Terms by displaying a message when You use the App. The revised User Terms shall be made available on the App. You are requested to regularly visit the App to view the most current User Terms. You can determine when Rentalex last modified the User Terms by referring to the “Last Updated” legend above.

It will be Your responsibility to check these User Terms periodically for changes. Your continued use of the App, following the changes to the User Terms, will constitute Your acceptance of those changes. Your use of the App and the Services is subject to the most current version of the User Terms made available on the App at the time of such use.

You agree to defend, indemnify and hold harmless Rentalex, its Partners, and its employees from and against any claim, demand, damages, obligations, penalty, losses, or actions (including reasonable advocate's fees) arising from

1. Breach of these Terms, the Privacy Policy; or
2. Violation of any applicable law, rules, regulations; or
3. Violation of the rights (including infringement of intellectual property rights) of a third party or Rentalex; or
4. Unauthorized, improper, illegal or wrongful use of your Account (including by you or by any person, including a third party, whether or not authorized or permitted by you).

You understand and agree that in case of events that are beyond the control of Rentalex such as satellite failure, Government restriction on the internet, or any Government orders resulting in non-availability or non-working of the App, You cannot hold Rentalex liable for it. Even if such circumstances result in non-performance by Owners/Seller/Renter, We will not be liable. The Services will be discontinued as long as the Force Majeure event continues.

These User Terms are perpetually binding You with us on downloading the App and creating an Account. If you delete Your account at any time, the agreement between us terminates.
We have the right but not the obligation to terminate Your account anytime with immediate effect if We have reasons to believe that You are in violation of these User Terms or found you misusing Our Platform or Services. We can terminate the agreement for any reason We find it just and equitable.

Your representations, undertakings, and warranties and the clauses relating to indemnities, limitation of liability, grant of a license, notice and takedown, Applicable laws of the country where the User is residing and dispute resolution will survive the termination of these User Terms (including but not limited to clause 5, clause 7, clause 8, clause 9, clause 10, clause 12, clause 14, clause 16, clause 17).

In case We receive complaints of Your content infringing the IP rights of other Users or Third-party, we will proceed as follow:

1. In case of complaints of copyright infringement, We may send You a notice regarding Your listing and in absence of any response or failure on Your behalf to showcase Your rights within thirty days (excluding non-working days), We will immediately remove the listing or take it down solely at Our discretion.
2. In case of complaints of violation of other IP rights, We have the right but not the obligation to take it down except as in clause below
3. On receiving court orders or Government notice against the contents of Your Ad it will be taken down without notifying You.
4. If the contents of your Ad(s) contain any obscene, inaccurate, offensive, indecent, objectionable, defamatory, or libelous content, then we may send You a notice regarding Your listing and in the absence of any response or failure on Your behalf to take down the objectional able content, We will immediately remove the listing or take it down solely at Our discretion.

These User terms are subject to the laws of the concerned country from where a User registers itself. All disputes arising from the use of Our App or relating to the breach of these User Terms will be tried to be settled amicably between You and Rentalex (collectively “Parties”) by contacting us at info@rentalexapp.com.

In case of failure to settle disputes or reach a solution, the dispute will be subject to the exclusive jurisdiction of courts in S.A.S Nagar, Punjab.

If You are a resident of any jurisdiction outside India and the contents of Your Ad is subjected to the laws of Your jurisdiction then these User terms may apply to You to the extent it is consistent with the applicable laws, rules, and regulation of Your jurisdiction. You should be aware of the relevant laws of Your jurisdiction outside India which may apply to the usage of Our App. Rentalex will not be liable for Your non-compliance to the applicable laws in Your jurisdiction and it will solely be Your responsibility to obey and abide by the laws of Your jurisdiction. Without limiting the foregoing, the charges of the Paid services will differ for You.
